KieferArt Custom Painting COMMITMENT FORM

This document summarizes the content of our consultations regarding your custom painting and formalizes our mutual commitment to the commission. Please review it all carefully. The Terms of Agreement is written in plain English, so please read that, too. As you know, this product is a one-of-a-kind hand-crafted item which will last through the generations. It's important that we are in agreement of the details before I begin painting.

DESCRIPTION:

(example) The painting will be based on 3 uploaded photographs (files: grandchild-britney.jpg, granddad-Henry.jpg and tuggy-bear.jpg). Try to place the image of the grandchild immediately to the left side of granddad. Use the couch in the granddad photo for both of them to sit. Incorporate the 'tuggy bear' (stuffed bear) onto the grandchild's lap. Use all colors found in the photographs. Granddad Henry's eyes are a deep green color, the grandchild's are dark blue. Try to make granddad look like he's smiling just a little (upturn the corners of the mouth slightly). PREFERENCE: a matte varnish for the painting and a glossy varnish for the frame (but the final decision can be made about that by the artist).

AGREEMENT TERMS

This agreement assumes that you have read the contents of the COMMISSION PROCESS page on this website and that you have a clear understanding of the difference between an OIL SKETCH and a FULL PORTRAIT.  If you have any doubt about that distinction, please review that page and any other pertinent information found in the COMMISSION INFO section of the website or contact KieferArt if you have any questions BEFORE YOU AGREE TO THIS COMMISSION. 

I will make every effort to create an accurate likeness of your subject(s). However, please keep in mind that the FINAL IMAGE IS NOT INTENDED TO BE "PHOTOGRAPHICALLY ACCURATE".  Your portrait will reflect my artistic interpretation of the subject(s), based on the information provided by you.  My efforts will be geared toward achieving both a physical likeness and a representation of the "spirit" of the subject.

It is important that you make every effort to PROVIDE ME WITH REASONABLY CLEAR SCANS OF AT LEAST TWO DIFFERENT PHOTOS OF EACH SUBJECT to help prevent mistaken shadows, shapes, skin tones, etc.  If eye color, hair color and other basic features are not apparent in the photos, you will need to at least verbally provide me with those details.  Your painting can only reflect as much detail as your photos contain.  Blurry photos necessarily result in paintings with generalized, broad brushstrokes, if the image is paintable at all.

The total price including s/h and taxes (if applicable) for OIL SKETCHES is required upon acceptance of this document. FULL PORTRAITS require a 50% downpayment of the agreed total project price (as indicated on this form) which is to be paid upon acceptance of this document.  Your payment will NOT BE REFUNDABLE ONCE I BEGIN PAINTING unless an unforeseen event would prevent me from completing the painting by the due date.  This would be an extremely rare situation, but if it occurred, you could either request a total refund of your payment (which would be issued promptly) or we could draft a new agreement which would reflect a revised due date.  Clicking the "I AGREE" button on this page will formalize our mutual investment in the project.   You will then be directed to a page with payment information and a printable version of this completed COMMITMENT FORM.  Once I receive confirmation from PayPal that your payment has been processed, I will devote a block of time to your portrait or oil sketch and begin work based on the project specifications and schedule detailed in this document.

For FULL PORTRAITS, I will post on the KieferArt MESSAGEBOARD a photo of the painting in progress soon after I get the general images on canvas. At that point, YOU WILL HAVE ONE OPPORTUNITY TO REQUEST MINOR PLACEMENT/DETAIL ADJUSTMENTS.  I will earnestly attempt to incorporate those changes and proceed to complete the painting.  NO CHANGES CAN BE MADE TO THE PAINTING SUBSEQUENT TO THAT.

For FULL PORTRAITS, once the painting is complete, varnished, dry to the touch* (and framed, if applicable), I will email you a photo of the completed work along with a link for you to make your final payment.  The BALANCE OWED MUST BE PAID IN FULL UPON YOUR RECEIPT OF THAT EMAIL, even if the painting is completed ahead of schedule (which is often times the case).  After I receive notice that your payment has been processed, I will carefully pack your painting and FedEx it to you promptly.

*Oil paintings cure at different rates depending on the paint thickness, type of medium and varnish used, etc., but most average about 6 months.  Avoid contact with the surface until then.

Your painting will be INSURED AND GUARANTEED for the duration of its transport to you (see COMMISSION PROCESS page).  After it is delivered safely, I can no longer guarantee the condition of the portrait (and frame, if applicable).  Harsh environments, high traffic areas, children, animals, high humidity, excessive exposure to the sun, accidental scrapes and punctures can limit the longevity of oil paint and canvas.  I highly recommend that you keep these issues in mind when choosing an appropriate location for your painting and add it to your personal property insurance policy.  However, KieferArt paintings and frames are painted and varnished with reputable, high-quality art products designed to protect them from common household pollutants, minor abrasions and incidental exposure to the sun to ensure that, to the greatest degree possible, your painting will last through the generations with minimal care (a KieferArt "Care and Feeding of your Oil Painting" information sheet will accompany your order).
